Terms of Service for Tumoment

Welcome to Tumoment (“Tumoment”, “we”, “our”, or “us”). These Terms of Service (“Terms”) govern your access to and use of the Tumoment platform, including our website at https://tumoment.progressivebyte.com, mobile services, and any related features (collectively, the “Platform”).

By accessing or using Tumoment, you agree to be bound by these Terms. If you do not agree, do not use the Platform.

1. Description of the Platform

Tumoment is an online platform that connects users with independent emotional coaches for virtual sessions, including video and audio calls. Tumoment does not provide therapy, medical care, or mental health treatment.

2. Eligibility

You must be at least 18 years old to use Tumoment. By using the Platform, you represent that you meet this requirement.

3. No Medical or Therapeutic Services

Tumoment is not a healthcare provider.

  • Coaches are independent professionals, not employees of Tumoment.

  • Coaching services are not therapy, counseling, psychiatry, or medical treatment.

  • Tumoment does not diagnose, treat, or prevent any mental health condition.

  • If you are experiencing a mental health crisis, call 911 or your local emergency number immediately.

4. User Accounts

To use Tumoment, you must create an account.

You agree to:

  • Provide accurate and complete information

  • Keep your login credentials secure

  • Notify us immediately of unauthorized access

You are responsible for all activity under your account.

5. Coaches

Coaches on Tumoment:

  • Are independent contractors

  • Set their own availability and pricing (unless stated otherwise)

  • Are responsible for the content and quality of their services

Tumoment does not guarantee outcomes from coaching sessions.

6. Payments & Fees

  • Payments are processed through third-party payment providers.

  • Fees are disclosed before booking.

  • All payments are final unless otherwise stated in our refund policy.

  • Tumoment may retain a platform service fee.

Tumoment is not responsible for payment processor errors or delays.

7. Cancellations & Refunds

Refund and cancellation policies may vary by coach and will be disclosed prior to booking. Failure to attend a scheduled session may result in forfeiture of payment.

8. User Conduct

You agree not to:

  • Harass, abuse, or harm coaches or other users

  • Use the Platform for illegal or fraudulent purposes

  • Record sessions without consent

  • Share false or misleading information

Tumoment reserves the right to suspend or terminate accounts that violate these Terms.

9. Intellectual Property

All Platform content, trademarks, logos, and software belong to Tumoment or its licensors. You may not copy, distribute, or exploit any content without permission.

10. Disclaimer of Warranties

Tumoment is provided “as is” and “as available.”
We do not guarantee uninterrupted access or specific results from coaching services.

11. Limitation of Liability

To the maximum extent permitted by law, Tumoment shall not be liable for:

  • Emotional, mental, or personal outcomes from coaching

  • Disputes between users and coaches

  • Indirect, incidental, or consequential damages

12. Indemnification

You agree to indemnify and hold harmless Tumoment from claims arising out of your use of the Platform or violation of these Terms.

13. Termination

We may suspend or terminate your access at any time, with or without notice, for violations of these Terms.

14. Governing Law

These Terms are governed by the laws of the United States and the State of New York, without regard to conflict of law principles.
